Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a) Worksite, Shop Area - An employee was making connectors for ducts using the Lockformer, CleatFormer, Serial # C131 62. The guard was cut out exposing some of the forming dyes of the machine; on or about 03/06/13.    b) Worksite, Shop Area - An employee was making connectors for ducts using the Lockformer, CleatFormer, Serial # C131 62. The employee was not protected from being struck by the discharge of the stock; on or about 03/06/13.    Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
