29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. a) On or about 3/13/13 inside building under renovation at 4245 McKinley Pkwy.,Hamburg, NY: An employee used a Hitachi Model C12RSH 12" Slide Compound Miter Saw to cut wood. The saw was connected to 120-volt ac power via a series of extension cords, the first of which was plugged into a wall receptacle in the building. No GFCI or assured equipment grounding program was being used. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: a) On or about 3/13/13 inside building under renovation at 4245 McKinley Pkwy.,Hamburg, NY: An employee used a Hitachi Model C12RSH 12" Slide Compound Miter Saw to cut wood. The saw was connected to 120-volt ac power via a series of two extension cords, the first of which was plugged into a wall receptacle in the building. The plug on the second extension cord in the series lacked a grounding prong. NO ABATEMENT CERTIFICATION REQUIRED
