29 CFR 1910.23(d)(1)(ii): Stairs having four or more risers were not equipped with standard stair railings or standard handrails as specified in paragraphs (d)(1)(i) through (v) of this section:  a.) Cement Batch Plant - On or about March 13, 2013, and at times prior thereto, employees were exposed to stairway that did not have standard rails (i.e. top rail and mid rail) on the open side of the stairs.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  a.) Cement Batch Plant - On or about March 13, 2013, and at times prior thereto, company employees were worked with and around hazards substances inculding, but not limited to, crystalline silica while loading cement trucks.  The company had not written and implemented a Hazard Communication Program.

29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area.    a.) Cement Batch Plant - On or about March 13, 2013, and at times prior thereto, company employees were potentially exposed to crystalline silica while loading cement trucks.  Hazard Communication training had not been conducted with employees.
