29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means, as set forth in subparagraphs (i) - (iii) of this paragraph:      a)  At the worksite and on March 13, 2013, a tubular scaffolding system, on the Greenbriar St side, had a frame base width of 5 feet and a platform height of 21 feet without being tied or braced to the building to prevent tipping.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:      a) At the worksite and on March 13, 2013,  a tubular welded scaffolding system was used at the worksite that contained numerous hazardous conditions that were not recognized by the employees due to the lack of training.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access:   a) At the worksite and on March 13, 2013, employees did not use an approved method of accessing scaffold platforms that were 21 feet above ground level.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).      a)  At the worksite and on March 13, 2013, an employee was working from the 3rd tier of a tubular welded scaffolding system along the interior courtyard of the building under construction without guardrails protecting all open sides and ends.
