29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.    a.  On or about March 13, 2013 - at the above addressed jobsite, an employee was performing carpentry operations from a self-made wooden scaffold, which was not designed by a qualified person, thereby exposing the employees to falls.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    a.  On or about March 13, 2013 - at the above addressed jobsite, an employee conducting carpentry operations from a self-made wooden scaffold, was not provided with a proper access ladder to the scaffold platform, thereby exposing the employee to the hazards associated with falls.

On or about March 13, 2013 - at the above addressed jobsite, an employee was conducting carpentry operations from a self-made wooden scaffold which did not have the working platform fully planked, thereby exposing the employee to falls of approximately twenty two (22) feet six (6) inches.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.    a.  On or about March 13, 2013 - at the above addressed jobsite, an employee conducting carpentry operations from a self-made wooden scaffold approximately twenty two (22) feet six (6) inches above a lower level, was exposed to injuries from falls due to the lack of adequate fall protection.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.     a.  On or about March 13, 2013 - at the above addressed jobsite, an employee performing material handling operations from the first floor deck, approximately thirteen (13) feet above the ground was not protected from falls, thereby exposing the employee to fall hazards.    b.  On or about March 13, 2013 - at the above addressed jobsite, an employee performing material handling operations from the attic floor deck, approximately nine (9) feet above the lower level was not protected from falls, thereby exposing the employee to fall hazards.
