29 CFR 1926.21(b)(2):   The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    (a)  Hazelwood Subdivision, on or about March 13, 2013, and at times prior thereto, employee(s) entered an approximately 8 foot deep by 5 1/2 foot wide trench with Class C soil and nearly vertical sides, without using cave in protection that was provided on the site.  Employees were not adequately trained to avoid unsafe conditions.      Note:  Abatement certification is required for this item.

29 CFR 1926.652(a):   Each employee  in an excavation was not protected from cave-ins by an adequate protective system.    (a)  Hazelwood Subdivision, on or about March 13, 2013, and at times prior thereto, employees entered a trench without cave-in protection that was approximately 8 foot deep by 5 1/2 foot wide trench by over 100 feet long.  The trench had nearly vertical sides and was in untested Class C soil.      Note:  Abatement certification is required for this item.
