29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment. a. On or about March 19, 2013, at the above located workplace, employees required to add metal working fluids (Hysol MB 50 and Picoforce 5155 NP) while milling and turning were exposed to the hazards associated with chemicals such as, but not limited to, triethanolamine and 2-Amino-2-methylpropanol. These hazards necessitated the use of personal protective equipment such as safety glasses and gloves to prevent occupational injuries or illnesses. The employer had not verified, through written certification, that a hazard assessment had been performed.

29 CFR 1910.138(b): Selection. Employers shall base the selection of the appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the task(s) to be performed, conditions present, duration of use, and the hazards and potential hazards identified. a. On or about March 19, 2013, at the above located workplace, employees required to mill and turn material were using metal working fluids (Hysol MB 50 and Picoforce 5155 NP) containing chemicals including, but not limited to triethanolamine and naphthenic oil, were provided cotton gloves. The employer did not base the selection of the appropriate hand protection relative to the tasks performed and hazards identified. Employees were thereby exposed to the hazards associated with chemical contact.

On or about March 19, 2013, at the above located workplace, employees required to add metal working fluids (Hysol MB 50 and Picoforce 5155 NP) while milling and turning were exposed to the hazards associated with chemicals such as, but not limited to, triethanolamine and 2-Amino-2-methylpropanol. The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in paragraphs (f), (g) and (h) will be met.
