OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of a Class IV Carbon Dioxide laser which can cause severe burns to the eyes and skin. a) Laser/kit assembly area - Two Industrial Laser Source Continuous wave 100 Watt class IV carbon dioxide lasers did not have a protective housing enclosure with interlocks in place around the laser beam's point of operation to prevent iinjurious levels of laser light from entering into the work area. Employees were not aware of laser hazards, protective eyewear or clothing was not worn by all exposed employees, and the laser area was not restricted or controlled to authorized employees, on or about 3/18/13. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
