29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) At the jobsite, on the Bank Alley side of the building, on or about 3/13/13: An employee had lowered the basket of an aerial lift he was operating onto the top side of a dumpster/rolling steel container, exited the basket, and proceded to climb to the ground via vertically stacked scaffold components. The employee was exposed to falls of approximately 7 feet and 6 feet from ground as he climbed down. b) At the jobsite, on the roof, on or about 3/13/13: Employees were arranging sections of masonry tiles in close proximity to an unprotected skylight opening, exposing employees to falls in excess of 60 feet to the lower level. c) At the jobsite, on the 3rd floor, on or about 3/13/13: Employees were working in an area where the gate protection for an open elevator shaft was not in place and the shaft access was unhindered. Abatement certification must be submitted for this item. Washington Street Partners was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.501(b)(1), which was contained in OSHA inspection number 190146, citation number 1, item number 7a and was affirmed as a final order on 6/21/12, with respect to a workplace located at 214-220 Warren Street.
