29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace: Employees were exposed to hazards associated with the forklift operations in that the forklift training program did not include formal training but only one on one practical demeonstration training. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): Employees were exposed to hazards associated with the forklift operations in that the Hyster electric forklift #2 was observed with defective items but did not pull out of service. a) The seatbelt was stuck, un-operational, cant pull out to use for restrain function, but was not repaired, replaced nor taken out of service. b) The back cover at the counterweight area behind the operator was taped all around to avoid falling out, drop down while driving. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.
