29 CFR 1926.651(c)(2):     A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    a)  The employer did not provide a ladder or a earthen ramp as a safe means of egress in and out of the 5 feet 6 inch trench excavation within 25 feet for the employees. The employees climbed the trench side wall(s) as a means of egress.

29 CFR 1926.651(k)(1):     An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:     a) The competent person onsite did not inspect and reassess the trench excavation throughout the shift and as needed to address the changing conditions of the trench as work progressed. Employees where working in the section of the excavation that lacked trench protection method(s) to prevent potential trench collapse of the trench side walls and a safe means of egress within 25 feet of the pipe laying operation.
