29 CFR 1926.451(b)(5)(i): The end of a platform 10 feet or less in length extended over its support more than 12 inches and the platform was not designed and installed so that the cantilevered portion of the platform is able to support employees and/or materials without tipping, or has guardrails which block employee access to the cantilevered end:    (a)Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, SW Wing on End: An employee was observed working from a platform which extended over its support approximately 21 inches. The planks were 10 feet in length and 10 inches in width. There was nothing in place to prevent the employee from working on that side of the platform or to prevent the plank from tipping, observed on or about 2/20/13.      NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(f)(14): Makeshift devices, such as but not limited to boxes and barrels, were used on top of scaffold platforms to increase the working level height of employees:    (a)Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, SW Wing Near End: An employee was observed standing on a bundle of insulation on the third level of the scaffold,  to elevate his working height, observed on or about 2/20/13.      NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.    (a)Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, SW Wing Near End: Toeboards or other means to prevent materials and tools from falling over the edge were not provided on the scaffold , observed on or about 2/20/13. 29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level.    (a) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, SW Wing Near End: An employee was observed working on the third level of the scaffold, approximately 19 feet above grade, which was not provided with a guardrail system on the right side.  The employee was leaning over the edge on the right side adjusting materials, observed on or about 2/20/13.    The Jehu Garcia dba EMPA Construction was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 1926.451(g)(1), which was contained in OSHA inspection number 314211251, Citation number 2, Item number 4, issued on 6/1/2010 and was affirmed as a final order on 6/26/2010.    The Jehu Garcia dba EMPA Construction was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 1926.451(g)(1), which was contained in OSHA inspection number 312645724, Citation number 1, Item number 1(a) issued on 2/26/09 and was affirmed as a final order on 3/20/2009.     NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
