29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: a) Hawkin Road & Bane Lane, New Egypt, NJ: A worker was performing carpentry work on the eave of a new resdential home from a man made bin that was supported by the forks of the Grandall 534C-9. The bin being used was not designed for this type of activity and the approximate height to where the work was observed was approximately 20 feet from the ground level, observed on or about 3/26/13. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): 29 CFR 1926.501 (b)(13) Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. a) Hawkin Road & Bane Lane, New Egypt, NJ: Employees were exposed to a fall hazard of approximately 25 feet from the eave to the ground level. The employees were preforming carpentry work such as but not limited to framing of a new residential home without fall protection, observed on or about 3/26/13. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
