29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    WORKSITE: The employees performing roofing activities on a gambrel roof with both 4/12 and 17/12 pitched roofs were not protected, from falls between 13 feet 9 inches and 22 feet 2 inches to the ground by use of a guardrail system, safety net system or personal fall arrest system.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.    WORKSITE: The side rails of the following ladders, used by employees to access the roof did not extend at least three 3 feet above the roof eave and no handhold or equivalent device was provided:       1. The Werner 40 foot aluminum extension ladder used to access the dormer roof.   2. The Louisville, 24 foot aluminum extension ladder used to access the front main roof.   3. The bottom half of a Louisville model L2121, 32 foot aluminum extension ladder used to access the rear main roof.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders shall be used at an angle such that the horizontal distance from the top support to the foot of the ladder is approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).  WORKSITE: The following aluminum extension ladders, used by employees to access/egress the roof during roofing activities were setup at an angle such that the horizontal distance from the top of the top support to the foot of the ladder exceeded one-quarter (1/4) the working distance of the ladder:  1. The Werner 40 foot aluminum extension ladder used to access the dormer roof.  2. The Werner model 1582-2, 28 foot aluminum extension ladder used to access the front main roof.  3. The Louisville, 24 foot aluminum extension ladder used to access the front main roof.  4. The bottom half of a Louisville model L2121, 32 foot aluminum extension ladder used to access the rear main roof.

29 CFR 1926.1053(b)(7): Ladders shall not be used on slippery surfaces unless secured or provided with slip-resistant feet to prevent accidental displacement. Slip-resistant feet shall not be used as a substitute for care in placing, lashing, or holding a ladder that is used upon slippery surfaces including, but not limited to, flat metal or concrete surfaces that are constructed so they cannot be prevented from becoming slippery.  WORKSITE: The Louisville, 24 foot aluminum extension ladder used by employees to access the front main roof from the neighbors yard was setup on a plastic tarp on the grass and the ladder was not positively secured to prevent the ladders from displacement.
