OSH ACT of 1970 Section (5)(a)(1):   Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards.  (a)  On or about 4/3/13 - Fabrication areas,  employees operated a World 70-E forklift that was not equipped with a safety restraint system.   Among other methods, one feasible and acceptable method to correct this hazard is to ensure that all forkllifts in use are equipped with a seatbelt restraint system and that operators are required to use the restraint system as specified in the American Society of Mechanical Engineers (ASME) B56.1b - 2000, Safety Standard for Low Lift and High Lift Trucks, Section 7.41, Operator Restraint Systems.

29 CFR 1910.134(c)(2)(ii):   The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:   (a)  On or about April 3, 2013 - Fabricators used 3M 60921 half-mask respirators during some stone fabrication tasks and a minimal program had not been established.
