OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    a)    On or about April 2, 2013, and times prior thereto, at the Highway 84/SR 82 jobsite in Valdosta, GA, the employer failed to ensure that 3/8 in. wide smooth-dowel steel poles based in concrete wash were protected, exposing employees to hazards not limited to broken and bruised ribs, internal injuries, and death by impalement.    ABATEMENT CERTIFICATION IS NOT REQUIRED.

29 CFR 1926.501(b)(7)(ii): Each employee at the edge of a well, pit, shaft, or  similar excavation 6 feet (1.8 m) or more in depth was not protected from falling by guardrail systems, fences, barricades, or covers:    a)    On or about April 2, 2013, and times prior thereto, at the Highway 84/SR 82 jobsite in Valdosta, GA, the employer failed to ensure that employees working near, and walking by the edge of a brick-lined drainage well, were protected from falling into the opening, exposing employees to falls of approximately 10 feet.    ABATEMENT CERTIFICATION IS NOT REQUIRED.

29 CFR 1926.150(c)(1)(viii): Portable fire extinguishers were not inspected periodically in accordance with maintenance and use of portable fire extinguishers, N.F.P.A. No. 10A-1970:  a)    On or about April 2, 2013, and times prior thereto, at the Highway 84/SR 82 jobsite in Valdosta, GA, the employer failed to ensure that a portable fire extinguisher mounted on a curbing machine was periodically inspected, exposing employees to fire hazards.  ABATEMENT CERTIFICATION IS NOT REQUIRED.
