OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from falling loads and/or lift parts:    a) On or about 4/9/2013, at the main shop area. Employees operated a portable hydraulic lift that was leaking hydraulic fluid and exposed employees to a struck by hazard.   Among other methods, one feasible and acceptable abatement method to correct this hazard is to:   Ensure the lift is operated in accordance with the Automotive Lift Institute, Inc. standard for automotive lifts, paragraph 4.4.4 which states; The lift owner or employer shall take all appropriate steps to follow the recommended inspection procedure of the manufacturer, but in no event shall the lift operator fail to inspect or take notice of the following features on a daily basis:   1) accessibility and readability of the operating procedures, safety tips and generic safety material;  2) accessibility and readability of safety warning labels;  3) readability of the rated load capacity of the lift;  4) proper operation of the lift controls (including over-travel shut off devices and synchronizing system), restraints and locking devices;  5) deformation or excessive wear of any lift structural components;  6) deformation or excessive wear of other components such as hoses, electrical wires, drive chains, wire rope or screws;  8) evidence of hydraulic or pneumatic leaks;  9) unusual noise, sudden movements, erratic operation or evidence of chips or fillings during use;    Abatement certification must be submitted with this item.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.  a) On or about 4/9/2013, at the parts storage area. The mezzanine was used as storage area and was not guarded with standard railing and toeboard.   Abatement certification must be submitted for this item.

A pedestal grinder was used without tongue guard.   Abatement certification must be submitted with this item.
