Section 5(a)(1): The employer failed to furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm in that employees were exposed to explosion hazards:    (a)   On or about April 12, 2013, for the employees flowing water back out of the well into an open-top flow back tank with hydrocarbon vapors present located approximately 20 feet from a diesel engine pump that provided an ignition source, Longhorn Service Company Rig 33 at Laroque 34-12H near Alexander, ND.  Abatement Note:  Among other methods, one feasible and acceptable method of abatement would be to follow the recommendations of American Petroleum Institute - Recommended Practice 54, Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations, Paragraph 12.1.8, "Discharges of oil or gas to the atmosphere should be to a safe area, preferably on the downwind side of the well and a minimum of 100 feet (30.5 m) from the wellhead, open flame, or other sources of ignition."

29 CFR 1910.23(a)(8):  Every floor hole into which employees could accidentally walk was not guarded or covered:  (a)   On or about April 12, 2013, for employees tripping out of the well with the area around the drill pipe having an opening of approximately 12 inches x 24 inches and exposed to a potential fall hazard of approximately 7 feet, 8 inches, Longhorn Service Company Rig 33 at Laroque 34-12H near Alexander, ND.
