Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees working in and near roadways were exposed to struck-by hazards from vehicular traffic.   a)  Tree Tech of Ohio LLC, Columbus Grove, Ohio:  On or about April 15, 2013, at address of 499 Cherry Street, Bluffton, Ohio, the employer did not ensure that each employee wore high-visibility clothing to warn on-coming traffic of their presence, to help prevent struck-by hazards posed by vehicular traffic.  Employees intermittently entered the public roadway where vehicles traveled while performing tasks related to tree trimming operations, such as picking up tree branches.

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) Tree Tech of Ohio LLC, Columbus Grove, Ohio:  On or about April 15, 2013, at address 499 Cherry St., Bluffton, Ohio, the employer did not ensure that each employee used appropriate eye protection while performing tasks related to tree trimming operations, such as, but not limited to clearing brush and downed tree branches, exposing employees to eye injuries.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:  a) Tree Tech of Ohio LLC, Columbus Grove, Ohio:  On or about April 15, 2013, at address 499 Cherry St., Bluffton, Ohio, the employer did not ensure that each employee used appropriate head protection while working below areas where tree trimming operations were taking place.  Employees were exposed to potential struck-by injuries caused by falling branches and/or equipment.
