OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to:  A drowning hazard.     (a)  Sewage treatment lagoon - On or about April 6, 2013, an employee was exposed to a drowning hazard when using a small boat to travel from the shore to a dredger in the lagoon without wearing personal flotation device.  The employee fell out of the boat and into the lagoon upon returning to the shore.

29 CFR 1910.141(b)(1)(i): Potable water shall be provided in all places of employment, for drinking, washing of the person, cooking, washing of foods, washing of cooking or eating utensils, washing of food preparation or processing premises, and personal service rooms.  (a)  Sewage treatment lagoon - On or about April 6, 2013, facilities were not available for washing the body after being contaminated with water and sludge from the sewage treatment lagoon.
