Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and crushed by hazards when working from an elevated work platform on a rough terrain forklift: (a) Gordy's Country Market project, Rice Lake, WI; Employees were exposed to fall/tip over hazards, at elevations of approximately 14 feet 6 inches above lower level, while working from a forklift basket that was not marked with a workload and empty weight markings and had floor dimensions greater than the overall width of the truck (measured across load bearing tires plus 10 inches on either side.)
