29 CFR 1926.501(b)(3): Each employee in a hoist area was not protected from falling 6 feet (1.8 m) or more to lower levels by guardrail systems or personal fall arrest systems:    a) On or about 4/17/13 at a new Assisted Living Facility being constructed in Springville, New York; an employee was pulling flooring materials up to the second floor from an awning roof. The guard rail was removed in the hoist area and there was no personal fall arrest in use to prevent the employee from potentially fall 11 feet.    NO ABATEMENT CERTIFICATION REQUIRED
