29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: T&M Pallet Co. Stewartsville, NJ worksite - The employer did not provide a continuing, effective Hearing Conservation Program for employees exposed to noise levels above 85 dBA. a) Outside at the Dismantling band saw (two man operation) - Employees were exposed to continuous noise levels of 94.6 dBA for an 8-hour Time Weighted Average (TWA), which is equivalent to a dose of 189.3%. Sampling time was 287 minutes. b) Inside Recycling area - Employees were exposed to continuous noise levels of 89.2 dBA and 88.7 dBA for an 8-hour Time Weighted Average (TWA), which is equivalent to doses of 89.96% and 84.25%. Sampling time was 376 minutes and 371 minutes respectively. c) Inside Repair area -Employees were exposed to continuous noise levels of 90.0 dBA for an 8-hour Time Weighted Average (TWA), which is equivalent to a doses of 100.2%.Sampling time was 294 minutes. Zero exposures were assumed for all un-sampled time periods. Condition noted on or about 4/25/2013.

Stewartsville, NJ worksite - Intrinsically safe electrical wiring was not provided where Class II combustible wood dust was allowed to accumulate on surfaces such as, but not limited to electrical equipment, floor, machinery, etc. in the Dismantling Areas. Means were not provided to prevent a fire/explosion hazard, in that, the machinery/equipment and/or wiring used in the Class II combustible locations were not approved for the Class II Division II locations. Equipment including but not limited to electrical outlets and junction boxes, light fixtures and wiring used was not instrinsically safe or explosion proof. Condition noted on or about 4/25/2013.
