Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:    (a) On or about April 18, 2013, for employees engaged in well servicing operations including but not limited to pulling tubing where the employer had locked the pumping unit power control switch in the "ON" position, resulting in potential struck-by hazards from the pump-head body, counterweights and other pumping unit components at Fladeland 11-30H, Lot 1, Sec 30-T154N-R92W, Ross, ND.    Abatement  Note: Among other methods, feasible and acceptable abatement methods to correct the hazard would be for the employer to ensure personnel correctly perform the lockout procedure for the well pumping unit to control the hazardous energy in accordance with (API) American Petroleum Institute Recommended Practice 54, Third Edition, (Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations), section 6.9, LOCKOUT/TAGOUT, subsection 6.9.1b: "Personnel should be trained and disciplined in the use of this system to prevent unexpected operation of any equipment that stores any type of energy that might inflict injury to personnel".
