29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: A). On or about 04/18/13, at the site of 11-22 44rd Rd. Long Island City, NY Employees working underneath of scaffolds were in danger of head injury from falling objects such as, but not limited to tools and buckets of paint from other employees who working on above section of the scaffolds. Protective helmets were not worn. ABATEMENT VERIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access: A). On or about 04/18/13, at 11-22 44th Rd. Long Island City, NY Employees were ascending/descending a mobile scaffold by climbing the frame and were in danger of falling approximately 6 ft to the ground. An access ladder or equivalent safe devices were not provided. ABATEMENT VERIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.
