29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).   (a)  120 Limekiln Road, New Cumberland - Employees performed work activities inside an unprotected excavation/trench without any form of protection from a cave-in hazard, on or about April 23, 2013.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:   (a) 120 Limekiln Road, New Cumberland - The employer did not ensure that the competent person conducted inspections of the excavation to ensure the type of soil was known and that a protective system was in place, thus exposing employee(s) to injuries, on or about April 23, 2013.      Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  (a) 120 Limekiln Road, New Cumberland - An employee used a folded step ladder to enter a trench.  The employer did not ensure that the step ladder was used in the manner for which it was designed, on or about April 23, 2013.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
