29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent.  a)  Gorrilla Baler; Sorter:  On or about April 24, 2013 the employer exposed the employee to noise at levels of 72.47% (equivalent to an 8 hour time weighted average TWA of 87.67 dBA) which is 1.449 times the Action Level of 50 % (equivalent to an 8 hour TWA of 85 dBA) while working in the sanitation process at the facility.  Results were calculated for a 365 minutes sampling period.  The employer did not administer a continuing, effective hearing conservation program.  b)  Gorrilla Baler; Sorter:  On or about April 24, 2013 the employer exposed the employee to noise at levels of 78.99% (equivalent to an 8 hour time weighted average TWA of 88.30 dBA) which is 1.579 times the Action Level of 50 % (equivalent to an 8 hour TWA of 85 dBA) while working in the sanitation process at the facility.  Results were calculated for a 514 minutes sampling period.  The employer did not administer a continuing, effective hearing conservation program.
