OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards. On or about April 17, 2013, an employee performing roofing activities was working from the mid and top guard rails of a manufactured man basket lifted by a JLG 8042 tele-handler fork lift. The employee was exposed to the hazard of falling approximately 15 feet to the ground below.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems or a combination of warning line system and safety monitoring system. On or about April 17, 2013, an employee performing framing activities on the roof of a commercial restaurant was not protected from falling where the employee did not connect the fall protection lanyard to a designated anchor. The employee was exposed to the hazard of falling approximately 20 feet to the ground below.
