29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):  a) Worksite, 1221 Dutch Broadway, Valley Stream, NY- Employee was working on the second level of a fabricated frame scaffold approximately 12' above the ground. The scaffold had only three planks installed. Three planks were missing leaving an opening approximately 30" wide; on or about 4/24/13.   Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access:  a) Worksite, 1221 Dutch Broadway, Valley Stream, NY- Employees climbed the frames and crossbracing of a fabricated frame scaffold to access and descend from the 12' level; on or about 06/29/12.      Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

The employee was not provided with a training program on recognition off fall hazards and the appropriate means to minimize the hazard; on or about 4/24/13.
