29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:    a)  Employees were working alongside two second floor wall openings, each greater than 28 inch W x 40 inch H wall opening with an inside bottom edge less than 36 inches above the walking surface and outside bottom edge greater than twelve feet above compacted surface, without using any fall protection.      b)  An employee who was working on the second floor at the center peak area of a building's gable wall was working from a step ladder positioned on a scaffold platform alongside a wall opening greater than 60 inch W x 40 inch H wall opening with an inside bottom edge less than fifteen (15) inches above the scaffold platform and the outside bottom edge eighteen (18) feet above compacted surface, without using any fall protection.
