29 CFR 1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person a) On or about April 25, 2013; roof area front peak; the anchor point (plate) used to hook the lanyard/fall protection while conducting roof work on the residential 12:12 pitch, roof 35 feet from ground level, was not properly secured to support 5000 pounds if an employee fell during his assigned duties; half the plate was nailed down.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b) a) On or about April 25,2013; roof area; employees were conducting roofing work on a 12:12 pitch roof at an estimated height of 35 feet to ground level without a personal fall arrest system in place to protect them from falling; employees were not hooked up. The Patch Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926 501(b)(13) which was contained in OSHA inspection number 313090912, citation number 1, item number 1 and was affirmed as a final order on May 29, 2009 with respect to a workplace located at 4724 Berkley Terrace NW Lot 41 Washington DC.
