OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling tree limbs during tree removal operations:  a) at the worksite - an employee was exposed to being struck by a tree limb while he was clearing tree limbs and brush in the road. A tree limb was cut while a worker was in the drop zone, on or about 4/19/13.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:  a) at the worksite - in the roadway - employees were exposed to being struck by falling tree limbs, in that, the employer did not ensure that the employees wore hard hats, on or about 4/19/13.
