On or about April 25, 2013 - at the above addressed jobsite, the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to employee protection when exposed to falls.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.   a.  On or about April 25, 2013 - at the above addressed jobsite, an inspection was not conducted by a competent person capable of recognizing and correcting impalement hazards associated with falls on to the fence, which could result in employee injuries.  b.  On or about April 25, 2013 - at the above addressed jobsite, an inspection was not conducted by a competent person capable of recognizing and correcting hazards associated with roofing operations, which could result in employee injuries.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a.  On or about April 25, 2013 - at the above addressed jobsite, an employee performing roofing operations approximately ten (10) feet seven (7) inches above the ground was not protected from falls, thereby exposing the employee to fall hazards.
