29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. (a) The employer does not ensure the use of fall protection during roofing work. The violation was most recently observed at 5092 Lena Avenue, Boise, Idaho, where three (3) employees were not protected from fall hazards up to 13 feet to the ground while performing roofing activities. To abate this violation, and to continue to comply with this occupational safety and health standard, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof or structure more than six (6) feet high without adequate fall protection at this jobsite and at all of employer's jobsites. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from fall hazards. The employer has a continuing obligation to comply with 29 CFR 1926.501(b)(13), the OSH Act, and all relevant occupational safety and health standards. Alpha Roofing & Construction LLC was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) that was contained in OSHA Inspection 471598, Citation 1, Item 1, issued on June 27, 2012; Final order date of July 24, 2012 with respect to the work site on the corner of Granger and Tweed Brook, Boise, Idaho. Alpha Roofing & Construction LLC was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) that was contained in OSHA Inspection 98254, Citation 1, Item 1, issued on September 30, 2011; Final order date of October 27, 2011 with respect to the work site at 4319 Masaia Way, Meridian, Idaho. Alpha Roofing & Construction LLC was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) that was contained in OSHA Inspection 92273, Citation 1, Item 1, issued on July 28, 2011; Final order date of August 26, 2011 with respect to the work site at Lot 6, Block 25, Tahiti Street, Meridian, Idaho. (a) The employer does not have a program to ensure compliance with fall protection requirements, and does not designate any competent person to ensure that workers engaged in roofing activities use appropriate fall protection. To abate this item the employer must initiate and maintain a program, including frequent and regular inspections by competent persons it designates, to ensure that workers use appropriate fall protection. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including the names and qualifications of the persons it is designating as competent, and a description of their responsibilities.
