29 CFR 1915.13(b)(7): A competent person did not test ventilation discharge areas and other areas where vapors may collect, to determine if vapors discharged from the spaces being ventilated were accumulating in concentrations hazardous to employees.     a)  Kirby barge 28194 - On April 24, 2013: Employees were exposed to hazardous concentration of vapors, when the six tanks containing natural gasoline residuals were being ventilated with pneumatic blowers placed on the open port holes of each tank. The employer did not determine the concentration of hazardous vapors in the discharge area of the vessel.    b)  Kirby barge 28182 - On April 24, 2013: Employees were exposed to hazardous concentration of vapors, when the six tanks which containing natural gasoline residuals were being ventilated with pneumatic blowers placed on the open port holes of each tank. 29 CFR 1915.74(c)(2): A safe walkway meeting the requirements of 29 CFR 1917.74(a)(7) was not provided to step safely to or from the wharf, float, barge, or river towboat.  a)  Kirby fuel barge 28182 located at the 200 Dunlap Road marina - On April 24, 2013 employees were exposed to a fall hazard when ascending and descending the walkway provided to access the Kirby 28194 barge.  The walkway was not provided with a railing on the left ascending side.

29 CFR 1915.82(d): The employer did not provide and ensure that each employee uses only explosion-proof, self-contained temporary and portable lights, approved for hazardous conditions by a nationally recognized testing laboratory (NRTL), in any area that the atmosphere is determined to contain a concentration of flammable vapors that are at or above 10 percent of the lower explosive limit (LEL) as specified in 29 CFR part 1915, subparts B and C.   a)  Kirby barge 28182 located at 200 Dunlap Road marina - On April 24, 2013 employees were exposed to fire and explosion hazards when the employer provided non explosion proof flashlights for use in a flammable atmosphere.  b)  Kirby barge 28194 located at 200 Dunlap Road marina - On April 24, 2013 employees were exposed to fire and explosion hazards when the employer provided non explosion proof flashlights for use in a flammable atmosphere.

29 CFR 1915.157(a): The employer did not ensure that employees used appropriate hand protection or protective clothing when exposed to hazards such as skin absorption of harmful substances, severe cuts, lacerations, abrasions, punctures, chemical burns, thermal burns, harmful temperature extremes, and sharp objects.    a) Kirby Barges 28194 and 28182 located at the 200 Dunlap Road marina - On April 24, 2013 employees were exposed to flash fires while working in an area containing flammable vapors and the employer provided employees clothing that was made of 65% Polyester and 35% cotton. The International Safety Guide for Oil Tankers and Terminals section 26.2.4 states clothing made of synthetic materials is not considered suitable for employees where they may be exposed to flames or hot surfaces in the course of their duties.

29 CFR 1915.131(g): Headers, manifolds, and widely spaced hose connections on compressed air lines did not bear the word 'air" in letters at least 1 inch high.   a)  200 Dunlop Road marina - On April 24, 2013 employees were exposed to struck-by hazard when the compressed air manifold used to supply pneumatic power to the ventilation fans on Kirby barge 28182 and Kirby barge 28194 did not bear any identification of its content.
