OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:      (a) 14701 Cavittsville Road, Trafford, PA 15805, on or about April 23, 2013, employees were exposed to the hazard of being struck-by falling limbs while cutting and removing felled tree limbs during tree pruning activities.  Employees were not kept out of the drop zone and a tag line was not used to direct the cut limbs to the ground.  A cut limb that was caught up in the canopy eventually fell from a tree being trimmed and struck an employee in the head.

29 CFR 1910.132(a):  Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:     a) Job site, 14701 Cavittsville Road, Trafford, PA 15805, on or about April 23, 2013, the employer did not ensure personal protective equipment was provided and used by employees engaged in tree trimming activities.  Employees did not wear hard hats or cut resistant pants while using chainsaws to clear felled limbs.  The employees were exposed to struck-by and cut-by hazards.

29 CFR 1910.132(f)(1): The employer did not provide training to each employee who is required by this section to use personal protective equipment:                                                                                                              a) Job site, 14701 Cavittsville Road, Trafford, PA 15805, on or about April 23, 2013, the employer did not provide training to employees in the use of personal protective equipment.  Employees were exposed to struck-by and cut-by hazards while engaged in tree trimming activities while not wearing hard hats or cut resistant pants.
