On or about April 29, 2013 - at the above addressed jobsite, the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to employee protection when exposed to falls.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a.  On or about April 29, 2013 - at the above addressed jobsite, an inspection was not conducted by a competent person capable of recognizing and correcting hazards associated with falls during carpentry operations, which could result in employee injuries.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a.  On or about April 29, 2013- at the above addressed jobsite, an employee performing carpentry operations from the roof deck, approximately fourteen (14) feet three (3) inches above the ground, was not protected from falls, thereby exposing the employee to fall hazards.  b.  On or about April 29, 2013- at the above addressed jobsite, an employee performing carpentry operations from a decorative column, approximately nine (9) feet two (2) inches above the ground, was not protected from falls, thereby exposing the employee to fall hazards.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a. On or about April 29, 2013 - at the above addressed jobsite, the employer failed to provide a training program for each employee who might be exposed to fall hazards.
