29 CFR 1910.178(p)(1):  Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s):    On or about May 1, 2013, at the above addressed worksite.    a.  An employee was exposed to ergonomic and struck by hazards while driving a powered industrial truck (Caterpillar, Serial No. 1CM01108) that had its seat broken and lacked a seat belt.      b.  Employees were exposed to a struck by hazard while working near a powered industrial truck (Caterpillar, Serial No. 1CM01108) that had its back indicator lights not working.       c.  An employee was exposed to an ergonomic hazard while driving a powered industrial truck (Komatzu, Serial No. 102840A) that had its seat broken.      d.  Employees were exposed to a struck by hazard while working near a powered industrial truck (Komatzu, Serial No. 102840A) that had a non-functioning front light and its back indicator lights broken.

On or about May 16, 2013, at the spray painting area of the above addressed worksite.  An employee that used chemicals for painting purposes (i.e. Paint, Red water reducible shopcoat, Delta Laboratories Inc.) was not provided with information and training, as evidenced by, among other conditions; employee lacked knowledge of location/availability of the company's hazard communication program; employee lacked knowledge of the purpose, location and availability of the required safety data sheets, etc.
