OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  a.  On or about April 30, 2013, at the job site located at 861 Classic Drive in Grove City, Ohio an employee was observed working from stacked plywood placed on the forks of a Pettibone rough terrain forklift elevated to a height of approximately 10 feet above the level below. The the employee was not utilizing personal fall protection, exposing the employees to the hazard of a fall from elevation.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a.   At the construction site located at 861 Classic Drive, Grove City, Ohio, employees were working performing framing work on a residential home with a 7 in 12 pitch, approximately 8 feet in height with no fall protection.
