29 CFR 1910.134(c)(2):   The employer did not develop and implement a respiratory protection program in accordance with sections i and ii of this paragraph (c)(2) for employees who chose to wear respirators where respirator use was not required:  (a) Shop: On or about 17 October 2012 and at times prior the Employer had not established a written respiratory program, had not verified that the employees were medically able to wear a 3M, model 6200, 1/2 face respirator, and did not ensure that the 3M, model 6200, 1/2 face respirators were properly cleaned, stored and maintained to prevent a health hazard to the user.
