OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being pulled into or caught-in the rotating parts of the CNC machine; On or about May 06, 2013, and at times prior thereto, the employer did not ensure that employees operated the CNC lathe machines in accordance with the manufacturers operating manual. Abetment language changed due formal settlement agreement. Among other methods, feasible and acceptable means of abatement would include operating the machine with the doors closed as outlines in the operating manual.

29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks; On or about May 06, 2013, and at times prior thereto, employees manually operating the CNC lathe machine to polish parts without guards in place were exposed to the hazards associated with being caught by the rotating parts or equipment.
