29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above a lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: (a) On or about April 29, 2013, and times prior, employees were exposed to injuries from falls to the lower surface of greater than ten feet while working from unguarded platforms elevated by a forklift truck with no fall protection. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) On or about April 29, 2013, and times prior, an employee was exposed to injuries from falls from a ladder that he was using to access the scaffold where the ladder was not extended at least three feet above the landing surface of the scaffold platform. Abatement Note: Abatement certification is required for this item (see enclosed Certification of Corrective Action Worksheet).
