OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that workers were on a mezzanine level that was not equipped with a barrier gate or chain at the ladderway access:      (a) On or about May 2, 2013 and at times prior, workers used a rolling ladder to access a mezzanine level at one of three openings four feet wide that did not have a barrier chain or gate to prevent a worker from falling more than 8.5 feet to concrete at the unguarded ladder access area.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that workers were exposed to electrical hazards:      a)    On or about May 2, 2013 and at times prior thereto, workers were exposed to the following hazards throughout the facility:      1.    Electrical shock when a bottle containing approximately onethird liter of liquid was stored on top of a front loading area circuit breaker panel.      2.    Delays removing power due to a circuit breaker panel not having adequate clear space about the panel caused by a battery cart parked within 21.5 inches of a front loading area circuit breaker panel.      3.    Accidental contact with live 120/208 v AC conductors and terminals without a dead-front cover on an electrical enclosure in the main passage between North and South Ranges.      4.    Electrical shock hazards where temporary service cords were used as a replacement for fixed wiring in the retail area of Range A South.      5.    Live insulated conductors of a temporary service cord were not completely protected from damage due to missing outer protective sheathing in the retail area of Range A South.  .

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that workers were exposed to caught-in and amputation hazards while working near thermostatically controlled exhaust fans driven by belts and electric motors that were unguarded:      (a) On May 2, 2013 and at times prior, workers in Range A North and D South were exposed to ingoing nip-point and amputation hazards when working adjacent to high-volume air movers, some with guards removed and some with installed guards that had holes cut in the protective mesh that would allow an arm to come into contact with the fan blades and pulleys.
