OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each of its employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees; in that employees were exposed to being injured, or mauled by bulls being herded into a milking parlor: Donnen Farms, Piffard, New York, holding area at the milking parlor. On or about May 8, 2013, employees working in the milking parlor were exposed to a mixed herd of bulls and cows during the "push" to move cows into the milking stations. A worker was attacked by a bull butting his legs and swept him off his feet onto his back. The bull kept pushing him and finally the bull lifted him with his head and threw the worker against a metal rail causing serious injury. The employer did not provide an effective training program for each employee who might be exposed to struck by and crushing hazards while working with mixed herds of cows and bulls. The training program shall enable each employee to recognize the hazards of working with mixed herds and shall train each employee in the procedures to be followed to minimize these hazards.
