Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a falling load belt and/or pumping unit parts during servicing activities:  (a) On or about May 1, 2013, for the employees servicing a Rotaflex® pumping unit on oil and gas well locations where one employee was fatally injured after being struck by a falling belt assembly while working under the load where the securing pins were removed prior to the belt assembly being properly restrained at Denbury Oil Well CHSU 11C-36SH 16 approximately two miles east of 89th Street, Marmarth, ND 58643.  Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard would be to follow the manufacturer's established Load Belt Replacement Standard Operating Procedures which states,  "All nonessential personnel should be completely out of the lift area including the area around the well head." and "At no time should load be suspended over personnel."

29 CFR 1910.180(h)(4)(ii): The employer did not ensure that employees were prohibited from standing or passing under a load on the hook:  (a) On or about May 1, 2013, for the employees servicing a Rotaflex® pumping unit on oil and gas well locations where employees were working under a suspended load of the top drum while it was being moved in order to access the load belt assembly during a load belt replacement servicing activity at Denbury Oil Well CHSU 11C-36SH 16 approximately two miles east of 89th Street, Marmarth, ND 58643.
