29 CFR 1926.100(a):   Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:      a)  Worksite, 215-235 Broadway, Long Beach NY- Employees were not wearing protective helmets and were exposed to being struck by asphalt shingles and tools while walking and working below overhead roofing work; on or about 05/14/13.        Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.102(a)(1):   Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents    a) Worksite, 215-295 Broadway, Long Beach NY - Employees were using a pneumatic nail gun to install asphalt shingles on the roof of a two story condominium. The employees were not provided with eye protection; on or about 05/14/13.      Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19

29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a)  Worksite, 215-235 Broadway, Long Beach NY - Employees were removing and replacing asphalt shingles on the roof of a two story condominium.  The employees were not protected from falling approximately 25ft to the ground below; on or about 05/14/13.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
