The employer did not ensure that employees utilized 100% fall protection as required by the standard.

29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface, the ladder's side rails did not extend at least 3 feet (0.9 m) above the upper landing surface being accessed, and a grasping device was not provided to assist employees in mounting and dismounting the ladder: On the job site located at 6405 S. 176th Street, Omaha, NE: The employer failed to ensure that the ladder used to access the roof was extended at least three feet beyond the roof line; the ladder was not secured to the roof with a rigid support as well as employer failed to provide a rope or other permissible grasping device to allow for the safe access for employees mounting and dismounting the ladder.

The employer had employees carry bundles of asphalt shingles staged in the driveway on to the roof of the residence using the 32 foot Werner aluminum extension ladder.
