29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:   (a)  At 230 Dartsan Dr., Phenix City, AL:  On May 15, 2013 and at times prior to; the employer failed to require the use of eye protection for employees while they used a pneumatic nail gun to nail top caps on a frame wall, exposing employees to struck-by hazards from nail fragments.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  At 230 Dartsan Dr., Phenix City, Alabama: On May 15, 2013 and at times prior to; the employer failed to provide adequate fall protection for an employee securing a top plate on a frame wall, exposing that employee to falls of 9.1 feet.
