29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: The employer failed to protect employees from potential electrical, caught between and amputation hazards associated with operating equipment that requires the de-energizing of stored energy when under maintenance, without having developed and implemented an effective written lockout and tag out program. This was most recently evident during the inspection of the facility located at 45-1026 Kamehameha Hwy, Kaneohe, HI 96744, where the employer has employees operating the Hobart vertical mixers without having developed a written Lockout and/or Tag Out program. Instances include but are not limited to: i. Failed to train employees on the recognition and hazards associated with stored energy. ii. Failed to develop and train employees on the companys procedures involving the use of locks and tags as means of de-energizing equipment while in maintenance. iii. Failed to establish an agreement with outside contractors on which lockout and/or tag out program shall be utilized when working on company equipment on site.
