29 CFR 1915.14(a)(1)(iii): Employer did not ensure hot work performed on pipelines, pump fittings or other accessories connected to spaces that contain or have last contained fuel was tested and certified by a Marine Chemist.    (a) FV Ocean Cape, employer allowed welding on a fuel pipe in the port aft void that had not been tested of certified by a Marine Chemist.

29 CFR 1915.15(c): A competent person did not visually inspect and test each space certified as Safe for Workers or Safe for Hot Work as often as necessary to ensure that atmospheric conditions within that space were maintained within the conditions established by the certificate.  (a) On board FV Ocean Cape between May 20, 2013 and April 20, 2013 the shipyard competent person did not preform atmospheric tests of the spaces to maintain the marine chemist certificate as Safe for Worker/Safe for Hot Work issued for Misc. hot work on main deck and factory deck floor.
